Buyer agrees to the following terms and conditions:

I authorize you to contact Consumer Credit reporting agencies, all bank, credit and trade references herein to verify credit standing with them and authorize them to release said information to you.
I agree that invoices past due are subject to a 1.5% percent per month Finance Charge. Failure to pay the balance due and any incurred Finance Charges, may result in suspension or termination of credit at Hamilton Building Supply Company.
If it becomes necessary to effect collection, I agree to pay all costs of collection including actual court costs, agency costs, and attorney’s fees.
The credit limit may be changed at the discretion of Hamilton Building Supply Company without written notice and without affecting any personal guarantees.
Buyer agrees to provide Hamilton Building Supply Company with prompt written notice of any change in their name, address, ownership or form of business.
By signing the below, I certify that I am authorized to bind the company to the terms and conditions of this agreement.

I warrant that the information given is complete and true and that this information has been relied upon in the extension of credit. It is understood this information will be held in the strictest confidence.

When ordering material on behalf of an owner or contractor, I represent that I have entered into a written contract with the owner or contractor. I authorize Hamilton Building Supply Company to coordinate deliveries of materials on verbal or written orders under this agreement. I agree that unless otherwise noted, all invoices for material purchased will be paid in accordance with the credit terms. I agree that all special material orders ready for delivery but held at my request beyond 21 days will be invoiced for payment and incur an additional 3% per month Storage Fee based on the invoiced value. I agree that all discrepancies with deliveries must be communicated in writing within 1 business day of delivery.

Personal Guarantee of Payment

For the purposes of securing credit from Hamilton Building Supply Company to the undersigned, successors and/or assignees, I warrant and represent that the statements made and information provided in this application is complete, correct and true. The undersigned jointly and/or severally unconditionally and irrevocably guarantees the full and prompt payment of any balance due to Hamilton Building Supply Company possibly including Finance Charges of 1.5% per month applied against past due amounts. In the event legal action is initiated by Hamilton Building Supply Company to force payments of amount due, the undersigned jointly and severally guarantees to be liable for all attorney fees in the amount of 33% of the balance owed, including all costs and expenses incurred for such a situation, including collection agency fees and court costs. In the event of nonpayment by the referenced business, Hamilton Building Supply Company will be entitled to payment from the undersigned or their heirs, without prior demand or notice and without proceeding against the applicant first. The undersigned agrees that they have read and are familiar with the terms and conditions of sale and agree to be bound by them. I agree that as part of this application, Hamilton Building Supply Company may obtain a consumer credit report.

Execution of this document constitutes a person guarantee by the undersigned.
